HOUSE CONCURRENT RESOLUTION NO. 43

Requesting the Joint Committee on Government and Finance to make
a study of solid waste and solid waste disposal fees in West
Virginia.
Whereas, The West Virginia statutes regulating recycling,
solid and hazardous waste and the assessment of fees for all such
waste do not adequately define "solid waste disposal facilities,"
"industrial solid waste" and "construction and demolition waste";
and
Whereas, The West Virginia statutes that assess fees on solid
waste do not impose solid waste assessments fees on all solid
waste generated in West Virginia, regardless of whether it is
disposed of outside of West Virginia, and are otherwise in need
of review and study; and
Whereas, There is a continuing need to study and evaluate
solid waste disposal and its regulation in this State because of
the impact on the environment, public health, safety and welfare,
together with its economic impact and consequences; therefore,
be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby
requested to appoint an interim committee to study the West
Virginia solid waste statutes, procedures of governance and solidwaste disposal fees and to make recommendations to the
Legislature regarding the same; and, be it
Further Resolved, That the Joint Committee on Government and
Finance report to the regular session of the Legislature, 1997,
on its findings, conclusions and recommendations, together with
drafts of any legislation necessary to effectuate its
recommendations; and, be it
Further Resolved, That the expenses necessary to conduct
this study, to prepare a report and to draft necessary
legislation be paid from legislative appropriations to the Joint
Committee on Government and Finance.
